Conservatorships:
Protecting Loved Ones When They Can’t Protect Themselves
Sometimes, a loved one can no longer manage their finances, healthcare, or daily needs because of age, illness, or disability. When no advance planning is in place, a conservatorship may be necessary. At Capital City Wills & Trusts, PC, we help families across California establish and manage conservatorships with compassion and clarity.
What Is a Conservatorship?
A conservatorship is a court-supervised process in which a judge appoints a responsible adult, called the “conservator”, to make important decisions for someone who cannot care for themselves, known as the “conservatee”.
In California, there are two main types:
Conservatorship of the Person – The conservator makes decisions about healthcare, living arrangements, and personal needs.
Conservatorship of the Estate – The conservator manages finances, assets, and property on behalf of the conservatee.
When a Conservatorship May Be Needed
Families often turn to conservatorships when:
An elderly parent can no longer manage daily affairs or is vulnerable to financial abuse
An adult child with special needs turns 18 and requires ongoing assistance with medical or financial decisions
A loved one faces serious illness or cognitive decline without prior planning tools like powers of attorney or a living trust
